Terms of Service
By accessing or using any service provided by RUVCLOUD, you are deemed to have read, understood, and accepted all of these terms without reservation. If you do not agree to any term, stop using all services on this platform immediately.
1. Service definition
RUVCLOUD ("the Platform") provides short- and medium-term rental of physical Apple Silicon hosts ("the Service"), including but not limited to node access (SSH / VNC), an instance management console, and technical ticket support.
The Platform reserves the right to modify, suspend, or permanently discontinue any service feature at any time without prior notice and without liability for compensation.
2. Accounts and identity
Users may complete checkout and payment anonymously (device identifier only). If you register an account, you must provide a valid email address and are fully responsible for all activity under that account.
Sharing, selling, or transferring account access in any form is prohibited. If the Platform finds account abuse, it may suspend or close the account immediately without prior notice and without refund.
3. Billing and payment
All fees are quoted in US dollars (USD) and must be prepaid through the Stripe payment gateway before provisioning. The Platform does not store payment card data; payment security is handled by Stripe.
Service is prepaid in full for the selected billing period (daily / weekly / monthly / quarterly) and does not auto-renew. Renewal requires user action.
Prices may change at any time. New prices apply to orders placed after the change. In-progress order periods keep their original price.
4. Refund policy
The Platform provides digital services. Once provisioned, service is deemed delivered, and refunds are generally not supported.
The following are voluntary, non-binding refund considerations at the Platform's sole discretion:
- A node fails to provision within 4 hours of payment due to a Platform system fault and the user has reported it via ticket;
- After provisioning, the node is completely inaccessible for more than 24 consecutive hours (not due to user action or network issues), verified by the Platform.
Refunds will not be granted for: successful node login; node unavailability caused by user action; account suspension for terms violations; change of plans; or issues outside Platform responsibility such as network environment or hardware compatibility.
5. Availability and service levels
The Platform makes no uptime (SLA) commitment of any kind. Service is provided "as is" and may be interrupted for maintenance, hardware replacement, network issues, or force majeure.
Interruptions during planned maintenance are not a breach, and the Platform has no obligation to compensate.
6. Usage restrictions and prohibited conduct
Users must not use Platform nodes for any of the following:
- Sending spam, phishing, or any bulk unsolicited messages;
- Launching denial-of-service (DDoS) attacks, port scanning, or penetration testing against third-party infrastructure;
- Storing, distributing, or processing content that violates applicable law, including child sexual exploitation material;
- Cryptocurrency mining (unless explicitly permitted in writing by the Platform);
- Fraud, identity impersonation, or money laundering in any form;
- Resource use beyond the order scope, or excessive load on shared infrastructure.
The Platform may terminate violating accounts immediately without notice and forfeit any remaining service period.
7. Intellectual property
The Platform's branding, interface design, technical architecture, and all documentation are owned by the Platform. Users may not copy, modify, reverse engineer, or use them for commercial purposes.
Data uploaded to nodes remains the user's intellectual property. The Platform is not responsible for user data content on nodes.
8. Limitation of liability
To the maximum extent permitted by applicable law, the Platform's total liability is limited to fees actually paid by the user in the 30 days before the claim event.
The Platform is not liable for data loss, business interruption, lost profits, indirect damages, or punitive damages, whether under contract, tort, or any other theory.
9. User indemnification
Users agree to indemnify and hold harmless the Platform and its affiliates, employees, and agents for: violations of these terms; unlawful use of nodes; user content infringing third-party rights; and any third-party claims, litigation, fines, or reasonable legal fees arising from the above.
10. Account suspension and termination
The Platform may suspend or permanently terminate user accounts at any time without prior notice, including but not limited to:
- Violation of any provision of these terms;
- Signs of fraud, abuse, or unusual account activity;
- Requests from lawful law enforcement authorities;
- Legal or operational risk from continuing service, as determined by the Platform.
After account termination, all data on user nodes will be permanently deleted within 7 days. The Platform has no obligation to back up or migrate data.
11. Governing law and dispute resolution
These terms are governed by the laws of the jurisdiction in which the platform operator is established, without regard to conflict-of-law principles. Disputes arising from these terms or the Service shall first be resolved through negotiation; if negotiation fails, they shall be submitted to courts with jurisdiction in that jurisdiction.
Users agree to waive the right to bring any legal proceeding against the Platform as a class action or jury trial, to the extent permitted by applicable law.
12. Changes to terms
The Platform may modify these terms at any time. Updated terms take effect when published on this page. Continued use constitutes acceptance. Users should review this page periodically.
